<p>A spill from a fuel tanker rollover generated an emergency  response on a Florida roadway. The spill involved fuel impacts to the  travel lanes, the embankment supporting the on ramp, and the retention  pond at the toe of the embankment. Subsequent interim source removal  activities included soil excavation, free-product recovery, multiphase  extraction, and a series of chemical oxidation injections, performed as a  remediation pilot study. As the cleanup progressed and a remedial  action plan was being considered, a second spill event occurred at the  same location 2.5 years after the first one. The second event underwent  additional assessment, and two parties moved forward with a shared  remediation design and implementation. The remediation plan  implementation consisted of two chemical injection events into the  shallow portion of contaminated groundwater. The first injection event  consisted of a chemical oxidation reagent and the second event of  injection of a mixture of chemical oxidation and biostimulation  reagents. A third injection event consisted of a deeper injection  interval with a biostimulation reagent only. This case study chronicles  the implementation of multiple assessments and remediation  implementations for multiple spill events for a similar location, for a  site with multiple stakeholders and multiple constraints, including work  alongside an active roadway and in advance of a proposed roadway  construction corridor project.</p>

<p class="MsoNormal" style="margin: 0in 0in 0pt; text-align: justify;"><span style="font-size: small;"><span style="font-family: Verdana; mso-bidi-font-family: Arial;">Effective </span><span style="font-family: Verdana; mso-bidi-font-family: Arial;">November 17, 2010</span><span style="font-family: Verdana; mso-bidi-font-family: Arial;">, any site with a priority ranking score of 10 points or less may voluntarily participate in LSSI, whether or not the site is eligible for state restoration funding. The great news for business and property owners is that sites that are eligible for state restoration funding may receive payment of pre-approved costs, including 6 months of groundwater monitoring, not to exceed $30,000 for each site. Up to $10 million per fiscal year will be made available, on a first-come, first-serve basis. Through the assessment process, if the site meets the specified criteria, the Florida Department of Environmental Protection (FDEP) shall issue a determination of “No Further Action” acknowledging that minimal contamination is detected, the FDEP may issue a site rehabilitation completion order.</span></span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt; text-align: justify;"><span style="font-size: small;"><span style="font-family: Verdana; mso-bidi-font-family: Arial;"><br />

<p class="MsoNormal" style="margin: 0in 0in 0pt; text-align: justify;"><span style="font-family: Verdana; mso-bidi-font-family: Arial;"><span style="font-size: small;">The intent of the LSSI program is to eliminate sites from the program; not fully assess the sites.  FDEP expects most sites to not require anywhere near $30,000 to get to closure.  Assessments will be streamlined to collect only enough data to determine if the site will qualify for Site Rehabilitation Completion Order (SRCO), No Further Action (NFA), or No Further Action with Conditions (NFAC). At the end of the first event the site owner will have an opportunity and be required to review the initial assessment data with the contractor and decide if they want to proceed toward an SRCO, NFA, or NFAC.  The interim deliverable will include a signed document by the property owner on which path they choose. If a site does not qualify for closure based on site conditions, then no deductibles will be collected and the site will go back onto the pre-approval list for future funding based on the score and funding thresholds.</span></span></p>

LEED was developed by the United States Green Building Council (USGBC) and its purpose is to provide owners and operators a way to identify and then implement practical and measurable green building design and construction. The Green Building Certification Institute (GBCI) was established by USGBC in 2008. GBCI provides project certification programs related to green building and administers professional designations within the framework of USBGC’s system for rating green buildings. HCR is currently involved in implementing LEED designs in several of the projects we are managing, including many of the Florida Turnpike projects. 			<content:encoded><![CDATA[<p>New Jersey reportedly has more than 20,000 contaminated sites that require timely attention in order to clean up the environment. The Department of Environmental Protection (NJDEP) worked closely with the New Jersey Legislature and stakeholders to develop a program that completely changed the way sites are investigated and ultimately cleaned up. On May 7, 2009 the Site Remediation Reform Act, N.J.S.A. 58:10C-1 et seq. or commonly called “SRRA” was signed into law. Out of this law came another level of licensing, known as New Jersey’s Licensed Site Remediation Professional (LSRP).</p>
<p> </p>
<p>The implementation of SRRA was a bold step in codifying New Jersey’s environmental regulations, establishing the LSRP and changing the long standing Department paradigm of government oversight on the cleanup of properties. This sweeping change of regulations has created many challenging circumstances that are constantly evolving. Full implementation of these regulations and the dynamic process of engaging private property owners with LSRPs is scheduled to take effect in May of 2012.</p>
<p> </p>
<p>The NJDEP has taken a lead role in a partnership with the private consulting industry and has clearly demonstrated a willingness to see the success of this program. It begins with the arduous task of qualifying a LSRP. The applicant must demonstrate a long history of working with NJDEP’s Site Remediation Program. This is accomplished by serving a minimum of 5 years and 10,000 hours of “hands on” project oversight, including specific project information, NJDEP Case Numbers and the types of disciplines demonstrated for each of the projects. This coupled with a qualifying degree in environmental sciences, 40 hour HAZWOPPER and refreshers, and completion of mandatory training courses completes the application process which is then reviewed by the licensing board. A proficiency exam is to be created by the licensing board with a scheduled date of the exam to be announced.</p>
<p> </p>
<p>The NJDEP has repeatedly announced that they have a stake in the process of making this program a success. The Department constantly updates the program’s website, provides technical training sessions on their policies and interpretation of their regulations and continues to lead by being very proactive in the public relations outreach program. The LSRP program and SRRA regulations are dynamic and constantly changing, but the Department’s commitment to making this program a success has been well documented.</p>

HCR has zero tolerance for drug and alcohol usage with an ongoing random testing program and maintains a certified Drug Free Workplace.</p>

He started and operated his own environmental company “Air, Land &amp; Sea Environmental Management Services, Inc.” for 14 years. Not only is John a NJ Licensed Site Remediation Professional (LSRP) who has performed over 300 Phase I Site Assessments, NJDEP Preliminary Assessments (PA), and Phase II, but his services were provided to lending institutions, real estate investors and environmental attorneys. As a licensed Subsurface Evaluator/Tank Closure, he has experience in preparing Closure Plans, overseeing tank removals, and implementing site investigations and cleanup of soil &amp; groundwater contamination. His experience includes numerous Freshwater Wetland permit applications, transition area waivers, buffer averaging, Individual and General Permits, wetland delineations, Coastal Area Facility Review Act, and Environmental Impact Statements demonstrating compliance with these regulations.  In the Brownfield Re-Development arena, John has participated in Phase I and II – Environmental Site Investigations, assessed levels of soil contamination, characterized ground water contaminants and flow direction, assessed sensitive environmental receptors, and successfully remediated sites restoring the property value. He has served as a Special Environmental Consultant for several municipalities throughout the State of New Jersey and had worked closely with numerous large scale, heavy construction firms in New Jersey to implement improvements associated with Transportation Projects. He has managed projects ranging from complex, multi-million dollar commercial projects to single family homes.</span></p>

Any site with a priority ranking score of 10 points or less may voluntarily participate in the Low Scored Site Initiative program (LSSI), whether or not the site is eligible for state restoration funding. The great news for business and property owners is that sites that are eligible for state restoration funding may receive payment of pre-approved costs, including 6 months of groundwater monitoring, not to exceed $30,000 for each site. When property owners participate in the LSSI program owners may be able to increase the value of their properties by utilizing free program funding to remove the current environmental cloud on their property.
